These Terms and Conditions (“Agreement”) govern your use of the Website, products, services, and related materials provided by Global Meticulous Manicurist Nail Academy (“we,” “us,” or “our”). By accessing this Website or purchasing our products or services, you (“user,” “you,” or “your”) agree to be bound by this Agreement in full. If you do not agree, you must discontinue use immediately.

1. Eligibility and Registration

1.1 You represent and warrant that:

• You are at least 18 years of age, or you have obtained verifiable consent from your parent/legal guardian.

• You are not prohibited from entering into this Agreement under any law or judicial act.

• You are not a resident of a restricted jurisdiction or a member of a prohibited or terrorist organization.

• Global Meticulous Manicurist Nail Academy has not previously banned you.

• If registering on behalf of an organization, you have authority to bind that organization to this Agreement.

• Licensing Requirement (U.S.): Only individuals holding valid and eligible licenses from their state board of cosmetology may use the Certificate of Completion for marketing, advertising, or offering services to the public.

• International Exception: Training may be taken worldwide for personal development. In the U.K., our education is endorsed by HABIA for continuing education, and insurance may be obtained after course completion.

1.2 Account Security: You agree to maintain a secure password, protect your login credentials, and notify us immediately of unauthorized use. Each user is permitted one account; account sharing is strictly prohibited.

2. Acceptable Use

You agree not to:

• Sell, rent, share, or transfer Website access.

• Use content in schools, classrooms, or group instruction without written permission.

• Create, distribute, or promote competing courses or product lines using any portion of our intellectual property, methods, or branding.

• Engage in malicious, unlawful, or disruptive activity, including spam, harassment, or unauthorized code/scripts.

3. Intellectual Property Rights

• All Website content—including text, videos, images, graphics, documents, and course materials—is protected under copyright and other intellectual property laws.

• You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent.

• You may not use our name, brand, or logo except as specifically permitted for graduates (e.g., stating you are a “Graduate of The Meticulous Manicurist Pedicure Course and Member of The Meticulous Manicurist Network”).

• You may not present yourself as “The Meticulous Manicurist.”

4. Network Map & Professional Code of Conduct

• Graduates may subscribe annually for listing on the Global Meticulous Manicurist Network Map. Subscription fees are subject to change and are non-refundable if access is revoked.

• Map Subscription:

  • Subscriptions automatically renew each year.

  • You must cancel prior to the renewal date to avoid being charged for the following year.

  • Any refund that is approved is subject to a 6% + $0.60 transaction fee to cover processing costs charged by the payment processor.

  • Being listed on the Network Map is a privilege and is not included in your course purchase price.

• Deceptive Practices: Attempting to use the Meticulous Manicurist education or network for self-promotion without following company education practices will result in removal from the course and the Network Map. You must:

  • Maintain all legal requirements of the profession.

  • Work in a licensed establishment (including home or mobile salons).

  • Maintain liability insurance.

  • Maintain product liability insurance if selling your own product line.

  • Abide by FDA rules and regulations for product labeling if selling your own product line.

• Competing Courses and Products: Any user who creates, markets, or sells an educational course or product line in direct competition with Global Meticulous Manicurist Nail Academy will be immediately removed from the Network Map and terminated from all services, without notice and without refund.

• Use of the Term “Medical Pedicure”: Graduates and users of Global Meticulous Manicurist Nail Academy courses are strictly prohibited from advertising or promoting services under the title “medical pedicure.” Our training does not grant medical credentials or authorize the performance of medical procedures. Graduates may market themselves as restorative or advanced nail technicians in accordance with their cosmetology/nail license but may not represent themselves as providing medical care. Misrepresentation may result in immediate removal from the Network Map and termination of access, without notice and without refund.

• Private Facebook Group: Membership in the private Facebook Group is offered as a courtesy benefit and is not included in the course purchase price. Access is granted at our sole discretion and may be revoked at any time, without notice and without refund, for conduct that is unprofessional, disruptive, or inconsistent with the standards of this Academy.

Failure to meet these standards—including unprofessional behavior, mishandling client complaints, or client reports of misconduct—may result in removal from the map, network, or Facebook group without notice and without refund.

5. Payments and Refund Policy

5.1 Payments:

• All fees must be paid in full or through an installment plan.

• Installment users agree to complete all scheduled payments; failure to pay may result in suspension or permanent removal of access.

• Prices are in U.S. dollars and may be converted by your payment provider if outside the U.S.

5.2 Refunds:

• All sales are final.

• Limited 7-day money-back guarantee applies only if fewer than five modules are accessed.

• Refunds are subject to a 6% + $0.60 processing fee.

• Credit card fees are non-refundable.

5.3 Lifetime Access:

• All full-price course purchases include lifetime access unless terminated under this Agreement.

6. Affiliate Program

• Commissions are paid 30 days after the qualifying sale.

• Affiliates must maintain a valid payment method.

• Affiliates are prohibited from using deceptive advertising, spam, or unauthorized discounting. Violations may result in the withholding of commissions and termination of affiliate status.

7. Termination of Access

We may suspend or terminate your access immediately, without notice and or refund, if you:

• Create, market, or sell a competing course or product line.

• Operate outside legal/licensed requirements.

• Fail to maintain required insurance.

• Misuse of copyrighted materials or branding.

• Engage in fraudulent, deceptive, or unprofessional conduct.

Termination may include disabling accounts, revoking certificates, removing listings, and legal action.

8. Privacy & Data Collection

We collect information such as name, email, and account details for the purpose of providing services.

• Cookies may be used to improve user experience.

• Your data will not be sold to third parties.

• You may request deletion of your data at any time by contacting us.

• Data is retained only as long as necessary to provide services and comply with legal obligations.

9. Product Delivery & Support

• After successful payment, your order details will be emailed to you, and your purchases will be available in your account.

• Downloads and course access are managed through your login.

10. Warranties and Disclaimers

• All courses and products are provided “as is” without warranties of any kind.

• We make no guarantee that your results will match those of others.

• You are solely responsible for compliance with your state board regulations and insurance requirements.

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost business opportunities, or data loss.

• Our total liability for any claim shall not exceed the amount paid by you for the product or service in question.

12. Indemnification

You agree to indemnify and hold harmless Global Meticulous Manicurist Nail Academy, its officers, employees, and affiliates from any claims, liabilities, damages, or expenses (including attorney’s fees) arising from your:

• Violation of these Terms,

• Misuse of services or content, or

• Non-compliance with laws, licensing, or insurance requirements.

13. Force Majeure

We are not liable for failure to perform obligations due to events beyond our control, including but not limited to natural disasters, acts of God, pandemics, internet outages, labor disputes, government restrictions, or equipment failures.

14. Dispute Resolution

• This Agreement shall be governed by the laws of Arizona, USA.

• Any disputes shall first be subject to good-faith mediation in Arizona. If unresolved, disputes will be settled through binding arbitration in accordance with the rules of the American Arbitration Association.

• You waive any right to participate in class actions or consolidated claims.

15. Amendments

We reserve the right to update or amend these Terms at any time. Changes take effect immediately upon posting. Your continued use constitutes acceptance of the revised Terms.
