Terms and Conditions

These Terms and Conditions (“Agreement”) govern your use of the website, products, services, and related materials provided by Global Meticulous Manicurist Nail Academy (“we,” “us,” or “our”). By accessing this website or purchasing any product or service, you (“user,” “you,” or “your”) agree to be bound by this Agreement in full. If you do not agree, you must discontinue use immediately.

1. Eligibility and Registration

1.1 Representations and Warranties

You represent and warrant that:

• You are at least eighteen (18) years of age, or you have obtained verifiable consent from a parent or legal guardian.

• You are legally permitted to enter into this Agreement.

• You are not a resident of a restricted jurisdiction or a member of a prohibited or terrorist organization.

• You have not previously been banned or removed by Global Meticulous Manicurist Nail Academy.

• If registering on behalf of an organization or business, you have the legal authority to bind that entity to this Agreement.

Licensing Requirement (United States):
Only individuals holding a valid and eligible license issued by their state board of cosmetology or equivalent authority may use a Certificate of Completion for marketing, advertising, or offering services to the public.

International Exception:
Training may be taken worldwide for personal or professional development. In the United Kingdom, our education is endorsed by HABIA for continuing education, and insurance may be obtained following course completion.

1.2 Account Security

You agree to maintain the confidentiality of your login credentials and to notify us immediately of any unauthorized access. Each user is permitted one account only. Account sharing is strictly prohibited.

2. Acceptable Use

Intellectual Property & Account Protection

All course materials, videos, downloads, documents, tools, trademarks, systems, and proprietary methods are the exclusive intellectual property of Meticulous Manicurist® and are protected under United States and international copyright, trademark, and intellectual property laws.

Purchase of any course or program grants a limited, non-transferable, single-user license for personal use only.

Accounts may not be shared, transferred, sublicensed, or accessed by multiple users.

We reserve the right to monitor account access, usage patterns, login activity, and other identifying data for the purpose of protecting our intellectual property. Unauthorized multi-user access, distribution, reproduction, or sharing of materials — whether intentional or negligent — is strictly prohibited.

If suspicious or unauthorized activity is detected, we reserve the right to:

• Immediately suspend or terminate access without refund

• Revoke certification or licensing privileges

• Remove listing from referral or network directories

• Pursue legal remedies to the fullest extent permitted by law

By purchasing and accessing this content, you agree to these protections and enforcement measures.

You agree that you will not:

• Sell, rent, share, sublicense, or transfer access to the website or course materials.

• Use content in schools, classrooms, group instruction, or corporate training without prior written permission.

• Create, distribute, promote, or assist in competing courses or product lines using any portion of our intellectual property, methods, or branding.

• Engage in malicious, unlawful, deceptive, or disruptive activity, including harassment, spam, or unauthorized scripts or code.

2.1 Certified Salon License

The Certified Salon License is granted to a specific physical business location and permits access to the Meticulous Manicurist™ education platform for the number of licensed nail technicians purchased under the license. The base license fee includes one (1) Customized Pedicure Kit (retail value $183). Each technician seat includes course access and certification while actively employed at the licensed location. The salon agrees to verify and maintain documentation that each participating nail technician is legally licensed and fully compliant with all applicable local, state, and federal laws and regulations. License renewals are automatic and will be billed annually to the payment method on file unless cancelled in writing prior to the renewal date. Failure of payment, declined transactions, or chargebacks will result in immediate suspension of the Certified Salon License and removal from the Meticulous Manicurist™ Referral Network Map until payment is successfully processed and the account is brought into good standing. Meticulous Manicurist™ reserves the right to revoke or suspend the license for non-compliance with these Terms.

3. Intellectual Property Rights

All content provided through the website—including text, videos, images, graphics, documents, downloads, and course materials—is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, translate, reverse engineer, or create derivative works without prior written consent.

You may not use our name, branding, trademarks, or logos except as expressly permitted, such as stating you are a Graduate of The Meticulous Manicurist Pedicure Course and Member of The Meticulous Manicurist Network.
You may not represent yourself as “The Meticulous Manicurist.”

3.1 Protected Methods and Systems

In addition to copyrighted materials, the instructional methods, systems, protocols, frameworks, terminology, workflows, and educational structure taught within our courses constitute proprietary trade secrets and intellectual property of Global Meticulous Manicurist Nail Academy.

You may not replicate, teach, license, sell, adapt, or disclose these methods, in whole or in part, whether free or paid, without express written permission. This restriction applies regardless of format, including but not limited to live instruction, recorded video, social media, webinars, workshops, private coaching, or in-person training.

3.2 Trademark Use and Marketing Restrictions

The trademarks, service marks, and brand identifiers of Meticulous Manicurist®, including but not limited to “Meticulous Manicurist” and “Restore A Nail,” are the exclusive property of Lori Halloway and are protected under applicable trademark laws.

Graduates of the Meticulous Manicurist training programs are granted a limited, non-exclusive, non-transferable permission to reference their completion of the training in a truthful and non-misleading manner. This includes:

• Displaying a certificate of completion;
• Referencing completion of the Meticulous Manicurist course in a factual statement;
• Displaying any authorized badge or stamp of approval provided by Meticulous Manicurist.

This limited permission does not grant any right to use Meticulous Manicurist trademarks in a manner that suggests affiliation, endorsement, ownership, or brand association beyond the scope of course completion.

Prohibited Uses include, but are not limited to:

• Use of Meticulous Manicurist trademarks in website metadata, including but not limited to meta tags, keywords, page titles, or descriptions, for the purpose of search engine optimization (SEO) or traffic diversion;
• Use of Meticulous Manicurist trademarks in image alt text, hidden text, or backend coding for search ranking purposes;
• Use of Meticulous Manicurist trademarks in domain names, URLs, or paid advertising keywords;
• Any use intended to capture, redirect, or benefit from search traffic associated with Meticulous Manicurist or its products;
• Any use that may create confusion as to the source, affiliation, or endorsement of services or products.

Any unauthorized use of Meticulous Manicurist trademarks constitutes a violation of these Terms and may also constitute trademark infringement under applicable law.

Meticulous Manicurist reserves the right to revoke any permissions granted herein and to pursue all available legal remedies, including injunctive relief, damages, and recovery of attorneys’ fees, to the fullest extent permitted by law.

4. Global Meticulous Manicurist Network Map & Professional Standards

The Global Meticulous Manicurist Network Map is not simply a directory of course graduates. It is a referral and endorsement network designed to help the public locate professionals who continue to provide a client experience that is substantially consistent with the education, restorative philosophy, safety standards, and methods taught by Global Meticulous Manicurist Nail Academy.

The methods taught by Global Meticulous Manicurist Nail Academy were developed over decades of hands-on experience serving clients, educating professionals, and refining a restorative approach to cosmetic foot care. The public seeks out Meticulous Manicurist graduates because they associate the brand with professionalism, restorative foot care, safety, and the traditional water-soak pedicure taught throughout the STAR NT™ curriculum.

Every listing on the Global Meticulous Manicurist Network Map reflects the Academy’s confidence that the graduate continues to uphold the standards, professionalism, and client experience that have earned the public’s trust in the Meticulous Manicurist brand. Protecting that trust is the primary purpose of the Network Map.

Participation in the Network Map is a privilege, not a right, and Global Meticulous Manicurist Nail Academy reserves the sole and absolute discretion to determine whether a graduate remains eligible for continued participation.

Map Subscription Terms

• Listing on the Global Meticulous Manicurist Network Map requires an active annual subscription and is not included with course purchase.
• Subscriptions renew automatically each year.
• You must cancel your subscription before your renewal date to avoid future charges.
• Any approved refund is subject to a 6% plus $0.60 transaction fee to cover payment processing costs.
• Subscription fees are non-refundable if access or participation is revoked for any violation of this Agreement.

Required Standards for Continued Participation

Graduates listed on the Global Meticulous Manicurist Network Map agree to continuously maintain the standards required for participation, including but not limited to:

• Maintaining all required professional licenses, permits, establishment licenses, and registrations required by applicable federal, state, and local laws.
• Operating only from legally licensed establishments, including home salons or mobile salons where permitted by law.
• Maintaining active professional liability insurance.
• Maintaining product liability insurance when manufacturing, distributing, or selling products.
• Complying with all applicable FDA labeling and regulatory requirements when selling cosmetic products.
• Remaining within their legal scope of practice at all times.
• Maintaining professional conduct consistent with the standards taught by Global Meticulous Manicurist Nail Academy.

Providers operating from a home salon, mobile salon, or any non-traditional location are solely responsible for obtaining and maintaining any required establishment license, permit, inspection, or approval required by their jurisdiction.

Pedicure Method Standard

Graduates listed on the Global Meticulous Manicurist Network agree to perform pedicure services using the core methods taught throughout the STAR NT™ curriculum, including the traditional restorative water-soak pedicure as an essential component of the client experience.

Graduates who substantially depart from these methods—including replacing the restorative water-soak pedicure with a dry pedicure model or adopting service methods that are materially inconsistent with the education taught by Global Meticulous Manicurist Nail Academy—may no longer provide the client experience the public reasonably expects when choosing a Meticulous Manicurist graduate.

To protect the integrity of the referral network and the trust the public places in the Meticulous Manicurist name, graduates who advertise, promote, or primarily perform service methods that are materially inconsistent with the Academy’s education are subject to immediate removal from the Global Meticulous Manicurist Network Map and all related graduate benefits, without prior notice and without refund.

Deceptive Practices

Attempting to use the Academy’s education, reputation, trademarks, referral network, graduate status, or goodwill for personal promotion while failing to uphold the education, standards, methods, or professionalism taught by Global Meticulous Manicurist Nail Academy constitutes deceptive conduct.

Such conduct may result in immediate removal from the Global Meticulous Manicurist Network Map, revocation of authorization to use Academy branding or graduate badges, termination of related services, and any other action permitted under this Agreement, without prior notice and without refund.

Competing Courses and Products

Any user who creates, markets, sells, licenses, promotes, teaches, or participates in an educational course, training program, workshop, certification, digital product, coaching program, or physical product line that is substantially similar to, derived from, or directly competes with the education, methods, systems, or intellectual property of Global Meticulous Manicurist Nail Academy may be immediately removed from the Global Meticulous Manicurist Network Map, have all graduate benefits revoked, and have access to Academy services terminated without prior notice and without refund.

Prohibited Use of the Term “Medical Pedicure”

Graduates and users are strictly prohibited from advertising, marketing, or promoting services using the term “medical pedicure” or any similar wording that implies medical licensure, medical treatment, or medical authority.

The education provided by Global Meticulous Manicurist Nail Academy is cosmetic in nature and does not grant medical credentials or authorize the performance of medical procedures.

Graduates may identify themselves as STAR NT™ (Specialty Toenail and Restoration Nail Technician) graduates, restorative nail technicians, or advanced nail technicians only to the extent permitted by their professional license and applicable law.

Any misrepresentation of credentials or services may result in immediate removal from the Network Map, revocation of graduate benefits, termination of services, without prior notice and without refund.

Continued Compliance

Global Meticulous Manicurist Nail Academy continually evaluates and refines its educational curriculum, restorative methods, professional standards, and Network requirements. Continued participation in the Global Meticulous Manicurist Network requires graduates to remain substantially consistent with the current standards, methods, and professional expectations established by the Academy.

Global Meticulous Manicurist Nail Academy reserves the sole and absolute discretion to determine whether a provider remains eligible for continued participation in the Network.

Private Facebook Group

Access to any private Facebook group is provided as a courtesy benefit, not part of the course purchase. Access may be revoked at our sole discretion, without notice or refund, for conduct deemed unprofessional, disruptive, or inconsistent with Academy standards.

5. Payments and Refund Policy

5.1 Payments

All fees must be paid in full or through an approved installment plan. Installment users agree to complete all scheduled payments. Failure to pay may result in suspension or permanent termination of access. Prices are listed in U.S. dollars.

5.2 Refunds

All sales are final. A limited seven (7)-day money-back guarantee applies only if fewer than five (5) modules are accessed. Refunds are subject to a 6% + $0.60 processing fee. Credit card fees are non-refundable.

5.3 Licensed Access

All full-price course purchases include licensed access unless terminated under this Agreement.

5.4 Certificates

Certificates of Completion are non-transferable, revocable, and do not constitute a professional license or certification recognized by any state or medical authority.

5.5 Chargebacks and Fraudulent Disputes

By purchasing and accessing any course, digital product, or service, you acknowledge that delivery occurs immediately upon granting access.

Initiating a chargeback or payment dispute after accessing course materials, downloading content, viewing videos, or completing any portion of the program—outside of the stated refund policy—constitutes unauthorized use and may be considered fraudulent.

We reserve the right to contest all chargebacks and payment disputes by submitting evidence, including, but not limited to, access logs, IP address records, device login history, course progress data, download records, certificates issued, and communications.

In cases of suspected fraud or theft of digital services, we reserve the right to cooperate with payment processors, financial institutions, and law enforcement authorities, and to pursue all remedies available under civil and criminal law.

Any chargeback or disputed payment will result in immediate termination of access, revocation of certificates, removal from the Network Map, and permanent ineligibility for future services.

Reputational Protection and Credential Revocation

In the event of fraud, chargeback abuse, or material violation of this Agreement, we reserve the right to revoke all credentials, certificates, licenses, network listings, and public-facing affiliations associated with the Academy.

The user shall no longer be authorized to represent themselves as a graduate, licensee, or affiliate of Global Meticulous Manicurist Nail Academy in any capacity.

We may also notify relevant platforms, professional directories, payment processors, insurers, licensors, or governing bodies of the revocation of credentials where factually necessary to prevent misuse or consumer confusion.

6. Affiliate Program

Affiliate commissions are paid thirty (30) days after a qualifying sale. Affiliates must maintain valid payment information and comply with all promotional rules. Deceptive advertising, spam, or unauthorized discounting may result in withheld commissions and termination.

7. Termination of Access

We may suspend or terminate access immediately, in our sole discretion, without notice and without refund, for any violation of this Agreement.

7.1 Account Access Monitoring & Enforcement

We reserve the right to monitor account usage, including IP addresses, device logins, login frequency, and geographic location, to detect unauthorized access or account sharing.

If we determine that an account has been shared or accessed by multiple individuals, we may immediately terminate access, revoke certificates, remove Network Map listings, and deny refunds.

Termination may include disabling accounts, revoking certificates, removing listings, and pursuing legal action. Any violation of these Terms immediately voids all refund eligibility.

8. Privacy & Data Collection

We collect personal information to provide services and improve user experience. Data is not sold to third parties and is retained only as required by law or service delivery. Full details are available in our Privacy Policy.

9. Product Delivery & Support

10. Warranties and Disclaimers

All products and services are provided “as is.” We make no guarantees regarding results. You are solely responsible for compliance with licensing, insurance, and regulatory requirements.

Users agree not to make false, misleading, or defamatory statements about the Academy or its affiliates. This does not restrict honest opinions or lawful whistleblowing.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you for the applicable product or service.

12. Indemnification

You agree to indemnify and hold harmless Global Meticulous Manicurist Nail Academy from any claims arising from your violation of these Terms, misuse of content, or non-compliance with laws or regulations.

13. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control.

14. Dispute Resolution

This Agreement is governed by Arizona law. Disputes shall be resolved through mediation, followed by binding arbitration. Class actions are waived.

Injunctive Relief

We reserve the right to seek immediate injunctive or equitable relief for intellectual property violations without posting bond.

15. Amendments

We may update these Terms at any time. Continued use constitutes acceptance of revisions.
